Standard Limited Warranty to Original Purchaser

Scope

JAR Systems LLC (“JAR Systems”, “We”, “Our”, “Us”) warrants its device charging and management technologies (“Product”), subject to the exclusions and limitations set out below, against manufacturing defects in materials and workmanship for the following limited warranty periods:

• Power Banks: Active Charge Power Bank Products (“Power Banks”) shall be warranted against manufacturing defects in materials and workmanship for a period of one (1) year from the original date of purchase.

• Device Charging Cables: A Product’s device charging cables shall be warranted against manufacturing defects in materials and workmanship for a period of one (1) year from the original date of purchase.

• ADP for Device Charging Cables: A Product’s device charging cables shall receive accidental damage protection (“ADP”) for a period of one (1) year from the original date of purchase.

• Advance Replacement Service for Device Charging Cables: A Product that includes device charging cables qualifies for JAR Systems' Advance Replacement Service for a period of one (1) year from the original date of purchase.

• Electrical Components: The electrical components of a Product’s enclosure, not including Device Charging Cables or Power Banks, shall be warranted against manufacturing defects in materials and workmanship for a period of two (2) years from the original date of purchase.

• Advance Replacement Service for Quick-Sense USB-C Charging Hubs: A Product that includes a Quick-Sense USB-C Charging Hub (the “Hub”) qualifies for JAR Systems' Advance Replacement Service for a period of two (2) years from the original date of purchase.

• Structural and Mechanical Components: The structural load bearing and mechanical components of a Product’s enclosure shall be warranted against manufacturing defects in materials and workmanship for the Life of the Product.
• Certified Refurbished Charging Hubs: The electrical components, not including Device Charging Cables, of a Quick-Sense USB-C Charging Hub (the "Hub") replaced under JAR Systems' Replace Service shall be warranted against manufacturing defects in materials and workmanship for a period of one (1) year from the original date of purchase.

This Product is warranted against defects in materials and workmanship when purchased directly from JAR Systems or a JAR Systems authorized seller. This limited warranty begins on the original date of purchase (the ‘Warranty Period’) and is only valid and enforceable to the original purchaser (“you”, “your”) in the country where you purchased the product. Please contact JAR Systems for a current list of excluded items at 866-393-4202.

Definitions

• Device Charging Cables: Cables that connect and charge devices directly from a Quick-Sense USB-C Charging Hub or Active Charge Power Bank.

• Electrical Components: Electrical components core to the product’s functionality; does not extend to device charging cables or power bank accessories.

• Structural and Mechanical Components: Structural load bearing and mechanical components core to the product’s functionality.

• Manufacturer Defects in Materials and Workmanship: Defects that occur during the manufacturing process resulting in the product not meeting its intended quality or specifications.

• Accidental Damage Protection: Accidental Damage Protection (ADP) includes the physical damage from handling due to an unexpected and unintentional event. Coverage is provided for only operational or mechanical failure. It does not include protection against theft, mysterious disappearance, misplacement, and any other damage listed in the “Exclusions” section.

• Advance Replacement Service: Under this service, we will ship replacement Device Charging Cable(s) or Quick-Sense USB-C Charging Hub(s) via ground service within one business day of claim processing, subject to inventory availability, to minimize product downtime. For Quick-Sense USB-C Charging Hubs, the original Hub must be returned within thirty (30) days of the replacement Hub’s ship date to remain eligible for this service.
• Replace Service for Quick-Sense USB-C Charging Hubs: Under this service, we will ship Certified Refurbished Charging Hub(s) as replacements via ground service within one business day of claim processing, subject to inventory availability, to minimize product downtime. The original Hub must be returned within thirty (30) days of the replacement Hub's ship date to remain eligible for this service.

• Life of the Product: The length of time a Product is in production and has parts available for repairs and replacement.

Making a Claim

To obtain warranty service, support, or other information, please email Support@JAR-Systems.com or call 866-393-4202. When you contact us, please have the following ready: (1) your Product serial number(s), description of issue, and pictures of issue, in addition to (2) your original proof of purchase that shows the date of purchase and full details of the Product (if available). We will advise you of the process involved in making a claim. Any claim under this Limited Warranty is subject to you notifying us (or our authorized seller) of any alleged defect within a reasonable time of it coming to your attention and no later than the expiry of the Warranty Period.

Remedy

If a claim is received within the Warranty Period and the Product is found to have failed under the warranty we shall, at our option: (a) provide the necessary parts and instructions to repair the Product, (b) exchange the Product with a product that is new or which has been manufactured from new or serviceable used parts and is at least functionally equivalent to the original Product, (c) exchange the Product with a product that is new and upgraded model which has at least equivalent or upgraded function to the original Product, (d) credit a pro rata share toward a new JAR Systems Product as determined by the remainder of the warranty period of the purchase amount the customer paid for the Product.

When repairing or replacing the Product, we may use products or parts that are new, equivalent to new or re-conditioned. The Warranty Period will not be extended or renewed or otherwise affected due to subsequent exchange, repair, or replacement of the Product. Products that are exchanged, replaced, or repaired, as applicable, will be returned to you as soon as commercially practicable and warranted for the remainder of the original Warranty Period.

Exclusions

Any claim under this Limited Warranty requires a physical shipping address. JAR Systems is unable to deliver to P.O. Box, APO Box, and FPO Box addresses.

This Limited Warranty will not apply if the defect(s) relate to: (a) normal wear and tear (including, without limitation, wear and tear of batteries, if applicable), (b) defects caused by rough or inappropriate handling or use or damage caused by accident, misuse, neglect, improper ventilation, improper voltage capacity, fire, smoke exposure (cigarette or otherwise), water, disaster, lightning, or other acts of nature, (c) if the Product contains a battery and the fact that the battery has been short-circuited, if the seals of the battery enclosure or the cells are broken or show evidence of tampering or if the battery has been used with equipment other than those for which it has been specified, (d) non-compliance with the Product instructions, (e) willful or deliberate damage, neglect or negligence, (f) use of spare parts, devices, or other replacement items (including consumables) which are not provided or recommended by us, (g) any alteration or modification to the Product which has been carried out by you or a third party not authorized by us, (h) any failure to adequately package the Product for transportation, (i) extreme or external causes beyond our reasonable control including, but not limited to, breakdowns, fluctuations, or interruptions in electric power, (j) any Product(s) purchased from unauthorized sellers/distributors/resellers, (k) any Product(s) that are lost, stolen, or discarded, (l) any Product(s) gifted in goodwill to those affected by natural disasters.

This Limited Warranty will be invalid if (a) the Product’s serial number has been removed, erased, defaced, altered or is illegible in any way (as determined in our sole discretion), or (b) you are in breach of the terms of this Limited Warranty or your contract with us.

Limitation of Remedies

Your sole and exclusive remedy is Product repair, Product replacement, or pro rata refund of the Product at JAR Systems’ option, as provided in this Limited Warranty. This Limited Warranty replaces all other JAR Systems warranties and liabilities, whether oral, written, (non-mandatory) statutory, contractual, in tort or otherwise, including, without limitation, and where permitted by applicable law, any implied conditions, warranties or other terms as to satisfactory quality or fitness for purpose.

To the extent permitted by applicable law(s) JAR Systems does not assume any liability for loss of or damage to or corruption of other property, equipment, or data, for any loss of profit, loss of use of Products or functionality, loss of time, loss of goodwill, loss of business, loss of contracts, loss of revenues or loss of anticipated savings, increased costs or expenses or for any indirect loss or damage, consequential loss or damage or special loss or damage.  JAR Systems is not liable for (a) any property, equipment, service, or labor costs incurred in the event of Product failure, (b) any claim against you made by another party.

Some states do not allow exclusions or limitations of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific rights, and you may also have other rights, which vary from state to state. This Limited Warranty shall neither exclude nor limit (i) any of your legal (statutory) rights under the applicable national laws, or (ii) any of your rights against the seller of the Product

JAR Systems does not warrant uninterrupted or error-free operation of the Product. No warranty or guarantee given by any other person, firm, or corporation with respect to this Product shall be binding on JAR Systems. There are no warranties, express or implied, which extend beyond the description contained herein including the implied warranty of merchantability and fitness for a particular purpose.

Legal Disclosures

DISPUTE RESOLUTION/ARBITRATION AGREEMENT AND CLASS ACTION WAIVER: You agree that all individual claims or disputes arising from or relating to this Limited Warranty, whether in contract, tort, pursuant to statute, regulation, ordinance or in equity or otherwise will be settled by impartial arbitration in Sarasota, Florida. To initiate arbitration, You must notify JAR Systems in writing of Your desire to submit Your issue to arbitration. You are responsible for providing Us at least three (3) proposed arbitrators. JAR Systems has the right to question the proposed arbitrators to confirm neutrality and select any of the three to act as the Arbitrator. If JAR Systems demonstrates that none of the three proposed arbitrators are neutral, You may be asked to proffer additional arbitrators until one is selected. The Arbitrator is responsible for setting the ground rules and procedures for the arbitration. You agree to abide by the Arbitrator’s decision and share the cost of arbitration equally unless the Arbitrator directs otherwise.  You agree that the prevailing party shall be entitled to attorney’s fees and costs associated with the arbitration proceedings.

Entire Agreement: This Limited Warranty shall collectively constitute the entire agreement relating to Your limited warranty. No verbal or written representations by any Seller or marketing materials outside of this limited warranty shall be of any legal effect to this limited warranty.
